Medina Victorious in Battle Against Republican Party of Texas
WHARTON, TX, Monday, January 4, 2010 – The Medina campaign announces the 1st Court of Appeals has decided in favor of Debra Medina in her lawsuit from last year against the Republican Party of Texas (RPT). Medina alleged the RPT violated law in the way it operated its state convention and was forced to challenge the RPT in court in an effort to ensure party followed law.
Debra Medina said, “This welcome decision by the court validates months of hard work. I applaud the court for its decision to protect the plaintiffs from suffering further.”
The case originally was dismissed on an issue of jurisdiction. The controlling leadership (including former chairman, Tina Benkiser, who today serves as a senior advisor to Governor Rick Perry’s campaign) of the RPT has lied and misled grassroots members, trying to cover the truth about the original ruling claiming Medina’s actions were so egregious the court had issued sanctions and attorney fees. Neither of which was true. In order to make good on this allegation, the RPT returned to court to have the case reopened and obtained a $14,000 award for attorney fees. The appeals court ruled the award was improper and has dismissed the case.
